Terms of sale

The HUYGENS website is an e-commerce site selling cosmetic products, fragrances, home fragrances and home accessories. The Terms and Conditions of Sale published on the HUYGENS website are intended for users who place an order with HUYGENS via the website or by phone. They must have the legal capacity required to place an order. Anyone making a payment on the HUYGENS e-commerce website agrees to accept these Terms and Conditions of Sale, after having read them before confirming their order.

ORDERS:

The Customer selects the desired Products, adds them to their cart and then confirms their order after checking its contents and accepting these Terms and Conditions of Sale. If the payment is accepted, an acknowledgment is displayed confirming that the order has been recorded and announcing that a confirmation email will be sent. The products remain the property of HUYGENS until payment has been accepted and recorded.

HUYGENS reserves the right to refuse or cancel any order that is abnormal, fraudulent or placed in bad faith, as well as any order from a Customer with whom there is a dispute relating to the payment of a previous order.

PRODUCT AVAILABILITY:

Product offers are valid while stocks last. If a Product is unavailable after an order has been placed, the Customer will be informed as soon as possible and refunded.

PRICES:

The prices of HUYGENS products are expressed in euros, all taxes included (incl. VAT), or adjusted to exclude tax depending on the delivery address selected at the time of the order. They may vary over the course of the year. They include neither delivery costs — which will be invoiced to the customer by HUYGENS — nor any customs clearance fees — which are payable by the customer directly to the customs authorities.

HUYGENS reserves the right to change its prices at any time. Products are, however, invoiced on the basis of the price in force at the time the order is confirmed. 

DELIVERY:

HUYGENS delivers its Products in mainland France as well as in the countries offered at the time of ordering. The applicable delivery times and costs are indicated before the order is confirmed and may vary depending on the destination country and the delivery method chosen.

Orders are prepared and shipped as quickly as possible. The delivery times communicated are indicative and correspond to the times usually observed with carriers. Delivery times are provided for information purposes. In the event of a delay, the Customer benefits from the rights provided for by Articles L.216-1 et seq. of the French Consumer Code.

If the maximum period provided for by the provisions of the French Consumer Code is exceeded, the Customer may exercise the rights granted to them by Articles L.216-1 et seq. of the French Consumer Code.

Upon receipt of the order, the Customer is invited to check the condition of the parcel and the Products. Any anomaly (damaged parcel, missing or damaged Product) must be reported as soon as possible to the carrier and to HUYGENS customer service.

PAYMENT:

Payment may be made using the various payment methods available, at the customer's choice. HUYGENS products must be paid for in full at the time of ordering. The products remain the property of HUYGENS until their payment has been validated in full. The invoice is available on the site in the customer's personal account.

PAYMENT METHODS:

To pay for their Order, the Customer may choose from all the payment methods made available by HUYGENS, namely: payment by bank card, PayPal account, bank transfer, Apple Pay, iDeal, Google Pay, or instant transfer via the Fintecture solution. Payment is secured using the SSL system of the payment platforms. The customer's banking information is kept confidential through encryption, with no access for HUYGENS staff.

The Customer may pay with the ALMA solution. This interest-free payment in 3 or 4 installments by bank card is available free of charge from €80 in France. HUYGENS offers its Customers Alma's credit service for the settlement of their purchases and the execution of payment. This is conditional on the Customer's acceptance of the terms of use or credit agreement offered by Alma. Any refusal by Alma to grant credit for an order may result in its cancellation. Any termination of the Terms and Conditions of Sale binding the Customer and HUYGENS entails the termination of the terms of use or credit agreement between Alma and the Customer. The amount is paid by a credit granted by Alma SAS, registered with REGAFI under number 90876. In the event of a problem with Alma, you can file a complaint with Alma at https://support.getalma.eu/. Credit commits you and must be repaid; check your repayment capacity before committing.

COUPONS AND DISCOUNT CODES: 

Coupons and discount codes cannot be used to cover delivery costs. Coupons and discount codes cannot be combined unless otherwise indicated. 

Promotional codes can neither be exchanged for their monetary value nor refunded. Coupons are for single use: any unused amount will be lost.

HUYGENS reserves the right to cancel any benefit obtained fraudulently.

GIFT CARDS:

HUYGENS gift cards are valid for twelve (12) months from their date of purchase. They may be used in one or more purchases, up to their available amount.

Gift cards can neither be exchanged for cash nor refunded, including in the event of loss, theft or expiry of their validity period.

Gift cards cannot be combined with current promotional offers, discount codes or commercial benefits, unless expressly indicated otherwise by HUYGENS.

CUSTOMER REVIEWS:

The reviews published on the Site come exclusively from:

  • customers who left a review directly on the HUYGENS Site after purchasing a Product via the “Leave a review” feature;
  • reviews published on the HUYGENS Product pages of the blissim.fr website, identified by the words “Originally published on blissim.fr”.

HUYGENS does not modify the content of published reviews, except where intervention is required by legal obligations or in the case of content that is manifestly unlawful, insulting, defamatory or unrelated to the Product concerned.

RIGHT OF WITHDRAWAL:

Pursuant to Article L221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to justify their decision or bear any costs other than the cost of returning the Products. Products must be returned new and in their original packaging. Returns must be made within a maximum of 14 days to the address: HUYGENS Service Retours, 157 boulevard MacDonald, 75019, Paris. The right of withdrawal does not apply to unsealed products where they cannot be returned for reasons of hygiene or health protection (Article L221-28 of the French Consumer Code), where this exception applies.

When the customer wishes to exercise their right of withdrawal, Huygens undertakes to refund all sums paid, including delivery costs, without undue delay. The refund is made no later than 14 days from notification of the withdrawal, and HUYGENS may defer the refund until the goods have been recovered or proof of shipment has been received.

Pursuant to Article L221-14, Huygens is not required to refund additional costs if the consumer has expressly chosen a delivery method more expensive than the standard delivery method offered by Huygens.

LEGAL WARRANTIES OF CONFORMITY:

Products sold by HUYGENS benefit from the legal warranty of conformity provided for in Articles L.217-3 et seq. of the French Consumer Code, as well as the legal warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

The guarantor of the conformity of the Products is HUYGENS, whose registered office is located at 157 boulevard Macdonald, 75019 Paris.

The consumer has a period of two (2) years from delivery of the Product to act under the legal warranty of conformity.

During this period, the consumer is exempt from providing proof of the existence of the lack of conformity when it appears, except for second-hand goods.

In the event of a lack of conformity, the consumer may request the repair or replacement of the Product, under the conditions provided for by the French Consumer Code. If these solutions are impossible or entail disproportionate costs, they may obtain a price reduction or the termination of the contract, in accordance with the applicable legal provisions.

The consumer may also invoke the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code. In this case, they may choose between rescission of the sale or a reduction of the price, in accordance with Article 1644 of the French Civil Code.

RECOURSE TO A MEDIATOR:

In accordance with the provisions of the French Consumer Code, the Customer may have free recourse to a consumer mediator. To this end, you may use the consumer mediation services offered by Le Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C) by visiting their website. PERSONAL DATA PROTECTION:

HUYGENS collects and processes its customers' personal data for order management, customer relations, after-sales service, the performance of legal obligations and, where applicable, the sending of commercial communications where the Customer has consented to it.

The data controller is Mr. Daan Sins, President of HUYGENS.

Personal data is processed in accordance with Regulation (EU) 2016/679 of April 27, 2016 on data protection (GDPR) and the amended French Data Protection Act (loi Informatique et Libertés).

Data is retained for the time necessary for the purposes for which it was collected and may be transmitted only to providers involved in the fulfillment of orders (payment providers, carriers, hosting providers, technical or logistics providers), strictly to the extent necessary for their tasks.

The Customer has a right of access, rectification, erasure, restriction of processing, objection, as well as a right to the portability of their data, under the conditions provided for by the applicable regulations.

INTELLECTUAL PROPERTY:

HUYGENS is the exclusive owner of the images, texts, photos, trademarks, logos, signs, product names, music, video, data and all other elements making up the site. It is prohibited to reproduce, represent, modify, transmit or publish all or part of the site without the prior written authorization of HUYGENS.

MANIFEST ERRORS:

Despite the care taken in updating the Site, HUYGENS cannot be held liable for a manifest error relating in particular to the price, description, characteristics, photographs, availability or any other information relating to a Product.

In the event of a manifest error, HUYGENS reserves the right to cancel the order concerned and to inform the Customer as soon as possible. Any sums paid will be refunded in full.

CHANGES TO THESE TERMS AND CONDITIONS OF SALE:

HUYGENS reserves the right to modify the content of the Terms and Conditions of Sale at any time.

PARTIAL INVALIDITY:

If any provision of these Terms and Conditions of Sale is declared void or unenforceable, the other provisions shall remain fully applicable.

LANGUAGE:

These Terms and Conditions of Sale are written in French.

GOVERNING LAW:

These Terms and Conditions of Sale are governed by French law.

LIABILITY :

HUYGENS cannot be held liable for damage resulting from improper use of the Products or use that does not comply with the recommendations on their packaging.

FORCE MAJEURE:

HUYGENS cannot be held liable in the event of force majeure within the meaning of Article 1218 of the French Civil Code.
